Visiting the Scene of a Car Accident
In most car accident cases, we visit the scene of the accident and often videotape or photograph the area from several different angles. We also drive through the area of the accident to see with our own eyes our client's and the negligent driver's perspective. We do this for several reasons.
We like to see how easy it would have been for the negligent driver to avoid the collision. If the negligent driver had been paying attention or had been thinking clearly, how easy would it have been to avoid the collision? If there was nothing blocking the view of the negligent driver and plenty of opportunity to avoid the collision, the value of your case could increase.
Driving the area helps us understand the timing of the collision. People might not recall the sequence or timing of a collision and driving through the accident scene helps us verify the timing. Or, someone could have testified that it took X amount of seconds or minutes to make some kind of driving maneuver and driving through the accident scene shows that's impossible.
Finally, although Google Maps or Bing Maps can help us view an accident scene remotely, you get much better quality photographs by taking them yourself with a good camera or camcorder. Good photographs or videos can help demonstrate the basic facts of an accident to an insurance adjuster when you're trying to settle a case or to a jury if you have to go to court.
